All data provided by the customer will not, under any circumstances, be provided to third parties. These serve only for the correct processing of orders and, with prior consent, for sending our newsletters. Prices

Horta da Maria reserves the right to change prices and specifications without prior notice, however, if this change affects your order, we will contact you by email.

Promotions

All our promotions are limited and subject to existing stock and specific campaign conditions.

Offers

All orders may contain (in addition to the products purchased) other offers resulting from the partnerships established by Horta da Maria. They will always be limited to the existing stock and the permanence of these partnerships. Orders may also contain advertising material.

Delivery times

For orders made with payment confirmed until 11pm on Monday, orders are shipped on Wednesday, with delivery on the same day, between the regions of Setúbal, Lisbon and Leiria.

For orders made with payment confirmed until 11pm on Thursday, orders are shipped on Saturday, with delivery on the same day, between the regions of Setúbal, Lisbon and Leiria.

Orders placed outside these regions/zones are shipped by carriers.

When your order is shipped, you will receive a notification email with a location code and a link to the carrier's website, so you can track the delivery status of your order. If you do not receive your tracking code, please contact us.

Delivery times are indicative and, therefore, considered valid when there are no physical or structural impediments (example: incorrect addresses or force majeure setbacks, such as strikes, lost connections, bad weather, etc.) or in special times such as Christmas.

If the carrier is unable to deliver the order, it will try again the next day or contact you to schedule a new delivery. A notice may also be left to pick up your order at the delivery point closest to your address.

The delivery options presented may vary depending on the type of products to be delivered, the geographic area of ​​destination, the desired delivery mode (delivery to address or collection at a collection point).

It is not possible to choose a specific delivery time as it will be conditioned by the courier's route on the day of delivery.

The indication of an incorrect or incomplete delivery address may imply the return of the order to Horta da Maria and incur additional costs for the customer; for this reason, it is recommended that the customer always make sure that the delivery address, indicated when registering the order, is actually correct and complete. Once the order has been registered, it is not possible to change the delivery address or the billing data indicated.

If there are delays by the carriers, Horta da Maria cannot be held responsible.

Legal guarantee

Under the terms of Decree-Law No. 67/2003, of 8 April, amended by Decree-Law No. 84/2008,

of May 21, the products supplied may benefit from the warranty period of

compliance of 2 years from the date of delivery to the customer.

Allergen Warning

Pursuant to Regulation (EU) No. 1169/2011, of the European Parliament and of the Council, of 25 October 2011, we inform our customers of SUBSTANCES OR PRODUCTS THAT CAUSE ALLERGIES OR INTOLERANCES:

  • Cereals containing gluten;
  • Crustaceans and crustacean products;
  • Eggs and egg products;
  • Fish and fish products;

Shipping costs

The delivery cost will be shown at check-out and varies according to the quantity of products purchased, the weight and/or volume of the order, chosen shipping method and the final destination of the order.

Shipping costs will automatically update as the customer adds items to the shopping cart.

All specific purchase conditions will be clearly indicated in the ordering process and immediately prior to confirmation of the respective purchase.

Order tracking

Damaged products

If you have accepted the order and only later verified that any product is damaged inside, you must take detailed photographs of the product(s) and the shipping package (your name, address and tracking visible) and send them to the our email: orders@hortadamaria.com for us to solve. You will have to communicate on the day of delivery, otherwise we cannot conclude if the product arrived damaged or was damaged after receipt.

Returns

Horta da Maria, due to the type of products it sells, does not carry out returns, as they are fresh products and/or for direct consumption, they are not covered by the Decree-Law that regulates the return law.

Terms and Payment Methods

Upon completion of the ordering process as a guest or in the customer's personal account, the purchase will be registered and the customer has a deadline, indicated in the selected payment method, to proceed with the payment. At the end of this period, if there is no confirmation of payment and the option to send the order to be charged, if applicable, has not been selected, the order will be canceled. Some payment methods allow the recording of data necessary to carry out the payment transaction. However, in this context, no personal data of the customer will be kept, so their management should be done directly with the respective service provider. The situations in which the service provider allows the management of personal data to be done directly on our website are reserved, in which case, whenever they comply with the applicable legal provisions, in particular in matters of personal data protection, the indications issued by the former will be fulfilled. In any case, there is no retention of any payment data entered by the customer unless the supplier's platform allows it and the customer expressly consents.

Horta da Maria uses a sophisticated mechanism for detecting and preventing actions that indicate fraud. Through this solution, it is possible to verify the authenticity of payments made online, while safeguarding the integrity and security of customer data, as well as their identification. This security is made possible by SSL (Secure Sockets Layer) technology, which encrypts the communications produced between the client's software and our server so that they cannot be intercepted. As such, Horta da Maria reserves the right to refuse payment for an order if the respective transaction is considered illegal. Any and all activities considered illegal will be immediately reported to the competent authorities.

3D Secure is a communication protocol developed to improve the security of online payments and enable credit card user authentication with the issuing bank. After making a payment at an online store, a process is triggered that checks whether the card used is valid. Since the card is considered valid, the security systems associated with the 3D Secure protocol verify the customer's identity, using, in real time, the credit card issuer who, in turn, validates the customer's identity and reports the confirmation that the card used is legitimate. Such control is intended to protect credit card holders, by reducing the probability of fraudulent use of their cards, ensuring greater efficiency in the transaction.


3. ATM Reference

Since the bank reference generated for payment has a limited validity, failure to verify the payment within this period will result in the cancellation of the order. The indicated shipping deadlines will be complied with under normal conditions for processing orders, so the exceptional increase in the volume of orders that may occur during festive periods or during promotional campaigns, as well as other eventualities that hinder the regular provision of the delivery service.

4. MB Way

The customer may pay for their order via MB WAY. In the ordering process, you must select this payment method and indicate the mobile phone number to which the application is associated, access it and follow the purchase confirmation steps indicated. If the number entered does not correspond to a payment number registered in that application, the following message will be displayed: “It was not possible to validate your payment. We received the following message: Inexisting MB WAY alias”.

As indicated in the application, payment must be made within five minutes, under penalty of order cancellation.

5. Bank Transfer (after confirmation of purchase, you will receive an email with the details to perform the bank transfer)

The minimum value per order is €25 + VAT.

Warning:

Payments are always made in Euros, even when prices may be shown in other currencies. Some banking entities may charge exchange fees. Horta da Maria is totally alien to this fact, and therefore does not assume any responsibility for it.

Stock breaks

All items available at www.hortadamaria.com are in stock. If there is any flaw in the ordered item, we will send an email indicating the new expected delivery period, or we may suggest changing it to another similar item or refunding the amount paid.

Order cancellation


1. The Customer can always want to cancel his order before it is shipped.

2. All orders that are not paid within 5 working days will be automatically canceled by our system.

Age of consent

By placing an order in Horta da Maria, you are declaring that you are of legal age to purchase the products available on the online platform. If you are not of legal age or are not legally authorized to purchase certain products, we will be required to cancel the order.

Contract acceptance

All orders placed are subject to the right of admission, that is, we can choose not to accept the order.

Situations beyond Horta da Maria's control


We are not responsible for any failure, or delay in fulfilling any of our obligations, whenever such failure is caused by a situation that is beyond our control and/or is compromised by a third party. Food products are subject to constant changes which the consumer should always be aware of. Horta da Maria is not responsible for any divergences and/or modifications related to the information about the products present on our website, provided by the supplier/manufacturer, and that which appears on their labels. For this reason, we recommend that you always read the nutritional information, list of ingredients, recommendations for use, preparation and/or conservation, as well as all mandatory and/or voluntary information about a food product before using or consuming it..

Suggestions and Complaints

The opinion of customers is very important to Horta da Maria as it allows the implementation of improvements in the services provided. Thus, if for any reason the customers are not satisfied with them or with any of the products purchased, or even if they have any suggestions, Horta da Maria would appreciate it if any situation is reported to them within a maximum period of 14 days from the occurrence or receipt of the order by the recipient or by a third party designated by him, for one of the contact channels with the Customer Support service.

If you have accepted the order and only later verified that any product is damaged inside, you must take detailed photographs of the product(s) and the shipping package (your name, address and tracking visible) and send them to the our email: encomendas@hortadamaria.com so we can solve it. You will have to communicate on the day of delivery, otherwise we cannot conclude if the product arrived damaged or was damaged after receipt.

The customer must also keep in their possession, until indicated to the contrary by the Customer Service, either the defective, damaged or non-conforming product, or the respective order box.

WarningIf, as a result of the evaluation of the complaint presented, the customer is sent a product shipping coupon in a future order, this coupon must be activated within the validity period indicated on the same, under penalty of stock-out of the replacement product.
